Conditions of Participation:

This draw is conducted and organised by Planet49 GmbH, Oberliederbacher Weg 25, 65843 Sulzbach/Ts.

1. Registration

For registration at least the first and last name, address, telephone number and email address are to be entered by the participant. Furthermore it must be indicated that the participant is at least 18 years of age. The participant is solely responsible for any amendments to this data, in particular any necessary changes to the address and the email address details that the participant has provided to Planet49.

2. Eligible Participants

Eligible are all persons who, at the time of participation, are 18 years of age, who are participating from a location in the UK, Ireland or the United States of America and whose permanent residence is in the UK, Ireland or the United States of America. Excluded from this are employees, representatives, assignees and agents of Planet49 as well as all sponsors, advertising agencies and event coordinators involved in the company, including their family and household members, as well as all persons who are excluded from the draw according to number 13 of the conditions of participation.

3. Other Conditions of Participation

Participation is only possible via the Internet. Participation is in no way dependent on the purchase of merchandise, the claim of non-gratuitous services and/or the payment of connection charges and/or user fees to Planet49 or other companies involved with the organisation of the draw. By participating in the draw the participant declares his/her agreement to the rules of the draw as set out in these conditions of participation.

4. Determination of winners

The prizes displayed on the website will be drawn by lot among all participants on the date indicated on the website. All prizes shown on this website are subject to various prize draws.

5. Notification of the winners

Planet49 shall take steps to notify the winner of the relevant prize draw by email as well as by telephone if necessary. Notwithstanding the foregoing Planet49 shall not be obliged to take any particular steps to notify the winner of the relevant prize draw but will take such steps as it considers appropriate at its sole discretion. In the event that Planet49 is not able to contact the first randomly chosen winner within 14 (fourteen) days of the prize draw having taken place Planet49 shall, at its sole discretion and without there being any requirement for any further notice to be provided, be entitled to cancel the prize draw that has taken place and withdraw the prize which shall be forfeited by the first randomly chosen winner and a further prize draw shall then take place in which the prize shall be re-drawn.

6. Payment

Cash prizes will be paid by cheque. Other prizes will be sent to the address indicated at registration or, if necessary and depending on the nature of the prize and at Planet49’s discretion, must be picked up by the winner at Planet49's registered office.

7. Transferability and Taxes

Draw participations which are received are understood to be those of the participants from whose email address is being played. Prizes are not transferable before payment. Participation via front men is not permitted. The winner is solely responsible for the payment of accruing taxes if applicable.

8. Rules of conduct and disqualification

Planet49 and the sponsors have the right to disqualify participants and exclude them from the draw if they manipulate the participation process, the game and/or the "PLANET49" pages or as the case may be try to do so and/or break the game rules and/or otherwise unfairly and/or in a dishonest way try to influence the draw in particular by disruption, harassment, annoyance of employees/software of Planet49, the sponsors or other participants.

9. Termination Possibilities

Planet49 and the sponsors reserve the right at their sole discretion to be able to cancel or terminate the draw at any time without prior notice. In particular, but without limitation, this applies in the circumstances set out in number 5 of these conditions of participation or if the draw cannot operate according to plan for whatever reasons, such as the infection of computers with viruses, in the case of hard- and/or software errors and/or due to other technical and/or legal reasons which influence the administration, the safety, the integrity and/or the scheduled and proper execution of the draw. In such cases Planet49 and the sponsors also have the right to alter the draw at their discretion.

11. Legal Proceedings and Liability

Legal proceedings are excluded and in particular but without limitation no enforceable claim for payment or delivery of the prizes (as the case may be) exists. Planet49 and the sponsors are not liable for the loss, late arrival, delay, alteration, manipulation and/or misdirection of emails and/or data during data entry, logging, transmission and/or storage which are caused by external data networks, in particular the Internet or as the case may be the WWW, external telephone lines and/or other participants' and/or third parties' hard- and/or software; this also specifically applies for incorrect, missing, interrupted, deleted or defective data. Planet49 and the sponsors are also not liable for losses caused by or arising out of incorrect information and/or data which is supplied by participants and/or third parties, or is caused by their hardware and/or software and which is used for the draw or is associated with it. In particular no liability is assumed if emails or data entries (in templates on the "PLANET49" sites) do not correspond to the requirements established there and are consequently not accepted and/or assumed by the system. Furthermore Planet49 and the sponsors are not liable in the case of theft or destruction of the systems storing the data and/or storage media or in the case of unauthorised alteration and/or manipulation of the data in the systems and/or in the storage media by the participants or third parties. Moreover Planet49 and the sponsors are only liable for gross negligence or intentional actions of their legal representatives, employees or vicarious agents. In addition Planet49 and the sponsors are not liable for damages which occur to the winner or the winners' family members in conjunction with the prize. The preceding disclaimer does not apply as far as compulsory liability is being claimed e.g. in cases of intent, gross negligence, because of harm to life, body or health or because of breach of fundamental contractual obligations. Claim for damages for the breach of fundamental contractual obligations is however limited to contract coherent, foreseeable damage as far as liability for intent, gross negligence or harm to life, body or health is not being claimed. An alteration of the burden of proof to the disadvantage of the participant is not connected to the preceding regulations.

12. Linking

We hereby explicitly point out that due to placement of a link Planet49 and the sponsors do not take any responsibility whatsoever for the contents of the linked page. Planet49 and the sponsors emphasise that they have no influence on the design or contents of the linked pages. This declaration applies to all links to external Internet pages situated on Planet49 and the sponsors' website.

13. Severability Clause

Should a provision of the participation conditions be or become ineffective, then the effectiveness of the remaining provisions will remain unaffected. In such a case the organiser and participants are obligated to assist in establishing provisions in which preferably a result, economically approximate to the ineffective provision, is achieved.

14. Applicable Law

The draw is exclusively subject to the laws of the Federal Republic of Germany.
